We will make a reasonable effort to work with you toward an informal resolution.

25.2 Binding Arbitration

Except for matters that qualify for small claims court or where arbitration is prohibited by applicable law, you and Matrix Systems Consulting LLC, doing business as NexGen Smart Home, agree that disputes arising out of or relating to these Terms, the Website, the Services, or purchases made through NexGen Smart Home will be resolved through binding individual arbitration rather than in court.

Arbitration will be administered in accordance with the applicable rules of the American Arbitration Association ("AAA"), unless the parties agree to another recognized arbitration provider.

The arbitrator will have authority to award the same individual remedies that would otherwise be available in court, subject to applicable law.

You and NexGen Smart Home agree that neither party will bring or participate in a dispute as a plaintiff, claimant, or class member in any purported class, collective, consolidated, or representative proceeding.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.

If this class-action waiver is found unenforceable with respect to a particular claim or remedy, that claim or remedy will be handled as required by applicable law.

25.4 Small Claims Court

Either party may bring an eligible individual claim in small claims court instead of arbitration.

25.5 Intellectual Property and Injunctive Relief

Either party may seek temporary, preliminary, or injunctive relief in a court of competent jurisdiction where reasonably necessary to protect intellectual property rights, confidential information, or prevent unauthorized access to or misuse of the Services.

25.6 Nevada Law and Federal Arbitration Act

This dispute-resolution provision and any related dispute will be governed by the laws of the State of Nevada, together with applicable federal law.

The parties acknowledge that transactions conducted through the Website may involve interstate commerce. To the extent applicable, the Federal Arbitration Act will govern the interpretation and enforcement of the arbitration provisions contained in these Terms.

25.7 Legally Protected Rights
